That method of selecting pirate captains is actually historically accurate (well, minus the sword fight). In the Golden Age of Piracy, most captains were elected, and their crews could vote to depose them at almost any time. Unlike in a navy, if a pirate captain refuses to step down when his crew demands it, they can just kill him.
